Terms of sale and distribution of reference materials

  1. Reference materials (CRM, RM) can be purchased directly from the Reference Material Producer – CLP-B Sp. z o.o. (Proficiency Testing Center – CLPB LABTEST).

     

  2. The basis for the provision of the service is the placement of an order by the Client.

    Postal or fax orders should be sent to:

  3. All purchase orders must specify: Client details, name, symbol and batch of the reference material indicated in the catalogue, number of units of the reference material ordered, delivery address of the reference material and invoice shipping address.

     

  4. The order may only be signed by persons authorized to represent the Client.

     

  5. Placing an order is tantamount to accepting the terms of the offer and accepting the terms of sale and distribution of reference materials.

     

  6. CLP-B Sp. z o.o. supplies reference materials in sufficient quantities to meet market demand. However, in exceptional cases where only limited quantities are available, CLP-B Sp. z o.o. reserves the right to limit or reject orders.

     

  7. Reference material prices are valid for the current year. CLP-B Sp. z o.o. reserves the right to change prices without prior notice.

     

  8. In special cases, the costs of transport and packaging of reference materials may be added to the price of the reference material, after prior agreement of the terms by the Client.

     

  9. CLP-B Sp. z o.o. reserves the exclusive right to choose the appropriate mode of shipment of reference materials.

     

  10. If the Client does not report any potential discrepancies related to the order within three working days of delivery of the reference materials, the delivery shall be irrevocably deemed to be in accordance with the order.

     

  11. Each shipment contains reference material certificates, in quantities corresponding to the units of reference material ordered.

     

  12. The user of the reference material should ensure that the reference material certificate used is up-to-date (via the reference material manufacturer's website or by telephone/email contact with the manufacturer).

  13. The manufacturer generally does not accept returns, except for damaged or misshipped shipments. To return a shipment, please contact the Proficiency Testing Center to arrange the return. Returns do not include:

  • open packages of reference material;

  • partially used/modified reference materials;

  • damaged packaging of reference material (except for damage during shipment)

14. CLP-B Sp. z o.o. is not responsible for improper handling of the supplied reference material.

15. Every Client and other parties have the right to file a complaint. The manufacturer is obligated to review the complaint within four weeks of receiving it and to inform the Client or other parties in writing of any decisions made.

16. CLP-B Sp. z o.o., as a Reference Material Producer, is not responsible for changes occurring during storage of the material at the Client's premises, in particular in open samples.

17. The reference material manufacturer monitors the material's stability to quickly detect changes in material characteristics. The manufacturer is obligated to inform Clients of any changes to the reference material during the certificate's validity period. The expiration date for reference materials is shown on the RM/CRM certificate. The manufacturer is not responsible for damage, contamination, or other modification of the reference material.

18. If a change in the certified value of the reference material is detected in relation to the value given on the reference material certificate or its uncertainty, the manufacturer may decide to:

  • withdrawal of reference material from sale;

  • recertification of reference material.
